Terms of Service

Chapter 1 General Provisions

Article 1 Purpose

These Terms and Conditions are intended to define the rights, obligations, and other related matters between KIVA (hereinafter the "Company") and its members regarding the use of all services (hereinafter the "Service") provided by the Company, including procedures and conditions for service use, in accordance with the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, and other applicable laws.

Article 2 Definitions

The definitions of terms used in these Terms and Conditions are as follows: (a) Member: A person who has applied for membership by agreeing to the Company's Terms, has been approved by the Company, and has been assigned a user ID and password to use the services provided by the Company. (b) Registration: The act by which a person wishing to become a member agrees to these Terms and submits an application by filling in the required information on the Company's service application form, and the Company approves such application. (c) ID: A unique identifier consisting of a combination of letters or numbers chosen by the member, used by the Company to verify the member's identity when the member wishes to use the services. (d) Password: A combination of letters or numbers chosen by the member and shared with the Company, used by the Company to verify the member's identity during service use applications. (e) Operator: A person selected by the Company for the overall management and smooth operation of the services. (f) Withdrawal: The act by which a member terminates their service use agreement for any reason.

Article 3 Posting and Amendment of Terms

1. These Terms shall be posted on the Company's website or a linked screen so that users can view them. 2. The Company may amend these Terms without prior notice when necessary. Amended Terms shall be announced by posting on the Company's website for 15 days from the effective date, and shall take effect from the effective date specified in the supplementary provisions. 3. Members may refuse to accept the amended Terms, in which case they may discontinue service use by withdrawing their membership. 4. If a member continues to use the services provided by the Company after the amended Terms have taken effect, the member shall be deemed to have agreed to the amended Terms.

Article 4 Rules Outside the Terms

1. Matters not specified in these Terms shall be governed by the relevant provisions of the Telecommunications Basic Act, the Telecommunications Business Act, and other applicable laws. 2. The Company may establish detailed terms for individual services in addition to these Terms, and such details shall be announced through the service usage guide and separate consent procedures for the relevant service.

Chapter 2 Service Use Agreement

Article 5 Formation of Service Use Agreement

A service use agreement is formed when a member enters their information in the registration form prescribed by the Company, clicks the "Agree" button in response to the question "Do you agree to the Terms?", thereby submitting a service use application, and the Company approves it.

Article 6 Service Use Application

1. To use this Service, members must fill in their personal information on the registration form prescribed by the Company. 2. All information entered on the registration form must match the user's actual information. Users who do not enter actual information or enter false information cannot receive legal protection. 3. Overseas Koreans without authentication information or foreigners residing in Korea must attach a copy of their identification document as a file or send it to the Company by fax or email for identity verification. The Company will approve the service use application after verifying the identification. However, the relevant documents must be submitted within one month after applying for membership for the registration to be recognized. 4. The Company may approve group membership registration in limited cases where it deems necessary. 5. The information that members must provide is as follows: (a) General members: ID, password, name, authentication information, email address, postal code, address, phone number, mobile phone number, occupation. (b) Members under 14 years of age: ID, password, name, authentication information, email address, postal code, address, phone number, mobile phone number, academic status, legal guardian's (parental authority holder's) name, legal guardian's authentication information, legal guardian's contact information. (c) Overseas Korean/Foreign resident members: ID, password, name, gender, authentication information or alien registration number, email address, postal code, address, country of residence, phone number, mobile phone number, occupation, copy of identification. (d) Group members: organization name, abbreviated name, user ID, password, email address, office phone, address, area of activity, organization introduction, responsible person's name, contact information, and position.

Article 7 Approval of Service Use Application

1. The Company shall approve service use when a member submits a service use application with all information accurately filled in. However, approval may be denied or revoked in the following cases: (a) When the applicant does not use their real name. (b) When the applicant uses another person's information. (c) When the registration form contains false information. (d) When the applicant has engaged in acts prohibited by applicable laws and these Terms. (e) When the applicant has received criminal penalties for reasons falling under item (d). (f) When the applicant has a history of service use denial from another service provider. (g) When a minor under 14 years of age has not obtained consent from their legal guardian. (h) When the applicant does not meet other registration requirements set by the Company. 2. The Company may withhold approval of a service use application for technical or policy reasons.

Chapter 3 Service Provision and Use

Article 8 Provision of Services

1. In principle, the Service shall be provided 24 hours a day, 365 days a year, unless there are operational or technical issues or other exceptional circumstances. 2. The Company shall make efforts to provide stable services, and shall promptly repair and restore services in the event of unavoidable interruptions. However, services may be temporarily suspended for system maintenance, force majeure, emergencies, or other unavoidable reasons. 3. The services provided by the Company to members are as follows: (a) Viewing posts within the site. (b) Profile services within the site. (c) Registration, editing, deletion, and recommendation of posts including articles, blogs, videos, and photos. (d) Participation in events and activities hosted by the Company. (e) Mailing services. (f) All other services the Company develops internally or provides to members through partnership agreements with other companies.

Article 9 Service Use

1. Members may use the services listed in Article 8, Paragraph 3 immediately upon registration. 2. Members may raise any concerns regarding inconveniences in using the Service at any time. The Company shall make efforts to resolve such concerns when it deems them legitimate. 3. All responsibility for managing the member's ID and password rests with the member, and the member may not transfer or gift their ID to another person.

Chapter 4 User Content

Article 10 Definition of User Content

User content (posts) refers to the following items: (a) Opinions, questions, answers, images, videos, files, and links of all kinds posted by members on the Company's various bulletin boards. (b) Registered reader opinions, comments, images, videos, files, and links posted by members on site articles. (c) All other content posted by members in their capacity as members in the online spaces provided by the Company.

Article 11 Copyright of User Content

1. The copyright of content registered by a member belongs to the respective author. 2. The Company may comprehensively use the member's content within the Company's services, including reproduction, display, transmission, and distribution, and may edit or modify the content to the minimum extent necessary.

Article 12 Scope of Responsibility and Management of User Content

1. Any loss, damage, or other issues arising from a member's content and information are the sole responsibility of the individual member, and the Company shall not be held liable. 2. The member shall bear all costs required to resolve any claims, lawsuits, or disputes filed against the Company by third parties arising from the member's content. 3. The Company may delete content if it falls under any of the categories specified in Article 17. 4. The Company is not obligated to retain deleted content. 5. The Company is not obligated to inspect or censor all content. 6. The Company is not obligated to delete or retain content from members who have withdrawn or been expelled.

Chapter 5 Personal Information Handling and Use

Article 13 Personal Information Handling Policy

1. The Company protects members' personal information and announces it under the name 'Personal Information Handling Policy' on the main page of each service and the personal information management page. 2. The key contents mentioned in the 'Personal Information Handling Policy' are as follows: (a) Name/department/position/phone number/email address of the personal information management officer. (b) Purpose of collecting and using personal information. (c) Users' rights and how to exercise them, such as consent withdrawal and requests for access or correction. (d) Personal information items the service provider intends to collect. (e) Retention period, use period, and reasons for retaining collected personal information. (f) Other methods of processing or managing personal information. (g) Matters related to the operation of cookies. (h) Matters related to handling complaints regarding personal information. 3. When the contents of the 'Personal Information Handling Policy' are modified or changed, the Company shall announce the changes through posting on the website or other reasonable means prior to the modification.

Article 14 Use of Personal Information

1. With the member's consent, the Company may send introductory and promotional emails from sites affiliated with the Company to members. 2. The Company shall not disclose or distribute members' personal information obtained through service provision to third parties without the member's consent. However, exceptions are made when required by special provisions of law, and when provided in a form that does not identify specific individuals for purposes of statistical compilation, academic research, or market surveys. 3. The Company may use all or part of the member's information as statistical data related to its operations. 4. The Company may promote its business activities to members through electronic mail or other methods. 5. The member's consent to the use of personal information under each of the above paragraphs is deemed given when the member agrees to these Terms.

Chapter 6 Information Modification and Account Termination

Article 15 Information Modification

1. Members must immediately update their member information if any information provided at the time of registration has changed. 2. The member bears all responsibility for any issues arising from failure to update their information.

Article 16 Termination of Agreement

1. When a member wishes to terminate their service use agreement, they may request "Account Withdrawal" through the member information settings, and the withdrawal shall be processed immediately. Re-registration is not permitted for 3 months after withdrawal, and the member cannot use their previous ID upon re-registration. 2. The Company may retain information of a withdrawn member for up to 6 months from the date of withdrawal. 3. Information of withdrawn members retained by the Company may only be used for the purpose of personal information protection.

Chapter 7 Service Use Restrictions

Article 17 Service Use Restrictions

If a member commits any of the following acts, the Company may terminate the use agreement or restrict service use without prior notice: (a) Omitting or falsifying member information during registration or information modification. (b) Collecting, storing, or misusing another person's ID, password, authentication information, or other member information. (c) Infringing on the intellectual property rights or other rights of the Company, other members, or third parties. (d) Causing harm to the services provided by the Company, interfering with the Company's operations, or impeding other users' use of the Company's services. (e) Engaging in conduct that violates the regulations on inappropriate posts. (f) Other cases where the Company has substantial reason to determine that continued service provision is no longer feasible.

Article 18 Service Use Restriction Procedures

1. The procedure for restricting a member's service use consists of three stages: 1st Warning: Verbal or written warning. 2nd Warning: Suspension of posting privileges in the relevant area for 1 month. 3rd Warning: Revocation of membership. 2. When the Company revokes a member's membership (3rd Warning) during the service use restriction process, a disciplinary committee shall be convened. (a) Disciplinary Committee Composition: Composed of 3 heads of relevant departments. (b) Procedure: Verification of facts underlying the disciplinary referral, delivery of disciplinary referral notice, submission of explanation by the member subject to discipline (within 7 days of receiving the notice), unanimous decision to confirm the disciplinary action, and notification.

Chapter 8 Damages and Disclaimer

Article 19 Damages

The Company shall not be liable for any damages incurred by members in connection with the use of free services, unless caused by the Company's willful misconduct or gross negligence. Separate provisions shall apply to paid services.

Article 20 Disclaimer

1. In the event that the Company suspends services due to force majeure, emergencies, or other unavoidable circumstances, the Company shall not be liable for any issues arising from the service suspension. 2. The Company shall not be liable for service use disruptions caused by reasons attributable to the member. 3. The Company makes no warranty or guarantee regarding the suitability, accuracy, timeliness, or reliability of information, products, services, software, graphics, audio, or video provided through the Service. 4. The Company makes no warranty or guarantee regarding the suitability, accuracy, timeliness, or reliability of content posted by members. 5. Members are strongly advised to consult with a professional before making legal, medical, financial, or other decisions based on information obtained through the Service.

Chapter 9 Miscellaneous

Article 21 Grievance Handling

The Company shall collect members' opinions and receive complaints regarding personal information through telephone, written correspondence, email, or the company website, and shall process them accordingly.

Article 22 Dispute Resolution and Jurisdiction

1. In the event of a dispute regarding personal information, the Company and the member may apply for mediation of the dispute to the Personal Information Dispute Mediation Committee for prompt and effective resolution. 2. Any lawsuit arising from the use of the Service shall be filed with the court having jurisdiction over the location of the Company's headquarters.

Supplementary Provisions

These Terms and Conditions shall take effect from March 20, 2026.
